Terms of use
Version 2.1 · effective
1. Purpose
These general terms of use (the "Terms of Use") govern access to and use of:
- the ipand.io website and its forms (contact, demo, partnership);
- the app.ipand.io application;
- the mcp.ipand.io server, which allows a third-party artificial intelligence assistant of your choice to read your iPand data.
They are published by CODEVIUM SAS, a société par actions simplifiée (simplified joint-stock company) with a share capital of €1,000, RCS Paris 988 166 393, 60 rue François 1er, 75008 Paris ("iPand" or "we"). iPand is the name of the service.
The subscription to a plan is additionally governed by the General Terms of Sale (the "General Terms of Sale"), which prevail over the Terms of Use in the event of conflict. The terms specific to the MCP server and to Pandi, iPand’s GEO assistant, are set out in the appendix; this appendix forms part of the Terms of Use.
2. Acceptance
Website. Browsing the website does not require any registration. Use of the website and its forms is subject to the Terms of Use, available at the bottom of every page.
Application. Using the application requires acceptance of the Terms of Use. At sign-up, the notice under the account creation button tells you that by continuing, you accept the Terms of Use and the Privacy Policy, available through a link; creating the account constitutes acceptance. For each new version of the Terms of Use, a screen presents it to you when you sign in, with a link to the text, and you accept it with the "Accept and continue" button. Each acceptance is recorded with the version number accepted, its time and your account. As long as the version in force has not been accepted, the application remains inaccessible; you may then sign out.
3. The service
iPand measures the visibility of a brand, a product or an establishment in the answers of artificial intelligence assistants: six core engines (ChatGPT, Gemini, Google AI Overviews, Google AI Mode, Perplexity and Microsoft Copilot), of which each plan includes a number shown on the Pricing page, and Claude, Mistral and Grok in the Custom plan. The service queries these assistants with questions ("prompts") chosen by the customer, collects and analyzes their answers and the sources they cite, analyzes the pages of the customer’s website, and delivers indicators, recommendations, a conversational assistant and exports.
The application is reserved for professionals; it is accessible with a subscription to one of the Standard, Premium, Ultimate or Custom plans, one plan per brand, after a free trial where applicable (General Terms of Sale). Each plan sets limits (prompts, competitors, pages, engines, Pandi questions and contents, MCP requests and, in Custom, markets): beyond them, the addition or the request is refused, with no overage invoiced.
4. Nature of the indicators
The assistants’ answers vary from one day, one engine and one market to another. iPand’s indicators are trends established on a sample of answers: they constitute neither an exact measurement nor a guarantee of citation, position or commercial result. Part of the content displayed (analyses, recommendations, suggested prompts, assistant answers) is generated by artificial intelligence and may contain errors; you remain the sole judge of the decisions made on that basis.
5. Origin of the data delivered
The service delivers dated answers, each associated with a market and an engine, together with their analysis: whether or not the brand is cited, position, competitors mentioned, sources used.
The answers collected and the pages analyzed are third-party content. They are provided for analysis purposes; their accuracy is not guaranteed, and their reuse outside that purpose is your responsibility.
6. Third-party services and dependence on providers
The service relies on third-party services: the artificial intelligence assistants measured (the "engines"), the providers that collect their answers, and the language model, hosting, email delivery and payment providers described in the privacy policy. iPand has no control over these services.
An engine or a provider may become unavailable, change its answers, restrict or change its access, or change its terms, through no fault of iPand. iPand may then replace a means of collection or a provider with another. A day without collection from an engine, whatever the cause, gives no right to a refund or to compensation.
If an engine included in a subscribing customer’s plan becomes permanently inaccessible and iPand withdraws it, iPand informs the customer; the customer may then cancel the subscription concerned without charge and obtain a pro rata refund of the paid and unserved portion of the annual period, in accordance with the General Terms of Sale.
7. User account
Creation. An account is personal. It is created with a valid email address; since the service is reserved for professionals, you use your business email address. Login is password-free: by a one-time code sent by email, or through your Google or Microsoft account.
Security. You are responsible for the security of your mailbox and of the devices on which you remain logged in. You can view and close your active sessions from Settings › My profile. Report without delay to contact@ipand.io any unauthorized use of your account.
Accuracy. You provide accurate information and keep it up to date.
Deletion. You may delete your account at any time from Settings › My profile. Deletion is refused to the last administrator of an organization whose subscription is active: that administrator must first appoint another administrator or cancel the subscription. Your sessions, your Google or Microsoft logins and your membership in organizations are removed immediately; the account is erased 30 days later, in accordance with the privacy policy. The data of your brands remain with your organization.
8. Organization, roles and collaborators
Brands are grouped within an organization, which holds the subscription and the billing. The person who creates the first brand becomes its administrator. Disposable email addresses are refused when the first brand is created.
- An administrator manages the subscription, the brands, the members, the integrations and the archive of the organization’s data.
- A contributor works on the brands opened to them.
An administrator may invite collaborators by email; the invitation is valid for 7 days. The number of collaborators is not limited. The organization is responsible for the access it grants, for withdrawing it when a person leaves, and for the use of the service by its members. It ensures that its collaborators have been informed of the processing of their data (privacy policy).
9. Fair use
You undertake to use the service in accordance with the law, the Terms of Use and its intended purpose. In particular, it is prohibited:
- to track a brand without having a legitimate interest in it: your brand, that of a client who has engaged you, or that of a competitor in the context of a competitive analysis; competitive analysis is permitted, but using the results to disparage a third party is not;
- to audit a website of which you are neither the publisher nor engaged by the publisher; the service does not verify the ownership of the websites analyzed, and you are answerable for that choice;
- to extract the service’s data on a large scale by automated means other than the exports and the MCP server, or to resell or make available access to the service without written consent;
- to circumvent the limits of your plan, to open several organizations in order to multiply free trials, or to share an account between several persons;
- to attempt to access the data of another organization, to disrupt the service, to test its security without written authorization, or to introduce malicious code into it;
- to use the assistant or the prompts to produce unlawful content, or to attempt to divert the language models from their function.
Personal data in content entered. Prompts are transmitted, without your name or that of your brand, to the providers that query the engines; your messages to the assistant are processed by a language model. Do not enter personal data (name of a private individual, contact details, health data, etc.) in prompts, entity names, tasks or messages, unless necessary, and never sensitive data.
In the event of a breach, iPand may suspend the access concerned, after a warning except in cases of urgency or serious breach, without prejudice to termination as provided for in the General Terms of Sale.
10. Deleted prompts and content
A deleted prompt is archived: its history is kept and its slot is freed. Deleting a brand stops its collection and results in the erasure of its data within 30 days (General Terms of Sale).
11. Waiting list and website forms
If you signed up to iPand’s waiting list, your email address is used only to inform you about access to the service, on the basis of the explicit consent you gave. That sign-up, free of charge and without commitment, constitutes neither an order, nor a reservation of a subscription, nor a promise of price. You may unsubscribe at any time via the link included in each message or by writing to contact@ipand.io. Contact, demo and partnership requests do not bind either party.
12. Availability
The service is accessible 24 hours a day, except for interruptions for maintenance, incident or force majeure, without any guarantee of permanent availability. iPand may develop the service and add, modify or withdraw features; the withdrawal of an engine follows Article 6, and a change that substantially reduces a paid plan is dealt with in accordance with the General Terms of Sale.
13. Intellectual property
The website, the application, their software, methods, reference frameworks, texts, visuals, logo, mascot and interface are protected and remain the property of CODEVIUM SAS. Any reproduction, representation or adaptation, in whole or in part, without prior written authorization, is prohibited, except within the limits of the use of the service provided for by the Terms of Use and the General Terms of Sale.
The data you enter remain yours; you grant iPand the right to process them in order to provide the service. Third-party trademarks and logos mentioned belong to their respective holders.
14. Liability
iPand is bound by an obligation of means (best-efforts obligation). It cannot be held liable for decisions made on the basis of the indicators, recommendations or assistant answers, for the unavailability of or changes to third-party services under the conditions of Article 6, or for indirect damage. For subscribing customers, iPand’s liability is governed by the General Terms of Sale. You are responsible for the content you enter and for the use of the service under your account.
15. Personal data and cookies
The processing of personal data is described in the privacy policy, and trackers in the cookie policy. Where iPand processes data on behalf of a customer, the Data Processing Agreement annexed to the General Terms of Sale applies. For any question about your data: contact@ipand.io.
16. Suspension and termination
You may stop using the service at any time and delete your account (Article 7). iPand may suspend or delete an account in the event of a serious breach of the Terms of Use, fraudulent use or a security breach, after informing you by email except in cases of urgency.
17. Amendment of the Terms of Use
iPand may amend the Terms of Use. The version in force is published on the website with its date. A substantial amendment is announced by email or in the application at least 30 days before it applies, unless it is required by law or for security reasons. Each new version is submitted for your acceptance at your next login (Article 2). If you refuse it, you may delete your account; current subscriptions follow the General Terms of Sale.
18. Governing law and jurisdiction
The Terms of Use are governed by French law. In the event of a dispute, the parties first seek an amicable resolution, by writing to contact@ipand.io.
Failing that, if the user acts as a merchant (commerçant), exclusive jurisdiction is conferred on the courts of Paris. In all other cases, the ordinary rules of jurisdiction apply.
A website visitor acting as a consumer retains the benefit of the mandatory rules that protect them, in particular those of the law of their country of habitual residence and the rules of jurisdiction that are favorable to them.
19. Language
This text is written in French. Its translations are provided for information only; in the event of any discrepancy, the French version prevails.
Terms of the MCP Server and Pandi, the GEO Assistant — appendix to the iPand Terms of Use
This appendix forms part of the Terms of Use. It supplements the Terms of Use and applies to any person who uses Pandi, iPand’s GEO assistant, in the application or who connects a third-party assistant to iPand’s MCP server.
Part A — Pandi, iPand’s GEO assistant
A.1 You are interacting with an artificial intelligence
Pandi, iPand’s GEO assistant in the application, is an artificial intelligence system: its answers are produced automatically by a language model, not by a person. The assistant screen says so below the input field: "You’re talking with an AI: its answers may contain mistakes. Check important information.", with a link to this appendix. The assistant’s information window repeats it.
A.2 What the assistant does
Pandi answers your questions about the visibility of the open brand, based on that brand’s iPand data: visibility, prompts, collected answers, market players, sources, perception, analyzed pages, open tasks, brand profile, and iPand help sheets. It has no access to the web.
It works in three modes: discussion; drafting of content ready to publish (article, FAQ, product page) based on the brand’s visibility gaps and its profile; and correction of an analyzed page, based on its audit and its tags.
It changes nothing: it reads the data and may suggest tasks, which only you add, with one click, to your list. It publishes and deploys nothing: you review, publish and deploy its content and its fixes yourself. It makes no decision on your behalf.
A.3 Limits and reliability
Pandi’s answers may be inaccurate, incomplete or misinterpreted, even when they are based on your data: check the figures, the recommendations and the drafted content before acting or publishing. Pandi invents no testimonials, reviews, prices or customer names: what it does not know, it flags as "to be completed". The assistant provides neither legal advice, nor financial advice, nor any guarantee of results. The third-party content it cites (engine answers, web pages) is reported as collected.
iPand monitors the quality of the assistant: evaluation set, verification that the numbers cited appear in the data, links limited to those present in the data, instructions against hidden instructions in third-party content. These measures reduce errors without eliminating them.
A.4 Data processed
Your messages, the brand name, the date and the brand data needed for the answer are transmitted to a language model supplied by an AI model provider. The model is deployed in the European Union: requests and answers may be processed in any Member State of the Union. According to this provider, they are not used to train or improve its models. iPand requests that answers not be stored by the provider’s service.
The provider may nevertheless retain requests and generated content, in the European Union and for a limited period that it sets, in order to detect abuse. They are reviewed first by automated means and then, if necessary, by authorized employees of the provider located in the European Economic Area. iPand has not asked to be exempted from this storage.
Your first name is used for the greeting displayed; it is not transmitted to the model.
Your conversations are visible only to you. You may delete them: a deleted conversation is erased together with its messages 30 days after its deletion; the tasks you added from it remain. Conversations are also erased with the brand or your account; if you leave an organization, they are kept until the brand or your account is deleted (privacy policy). Your ratings (useful or not useful answer) are used to improve the assistant.
Do not enter unnecessary personal or confidential data in your messages.
A.5 Quotas
Each plan sets, per brand and per billing month, a number of questions (discussions and corrections) and of drafted contents, shared among the brand’s users (Pricing page; quote for the Custom plan). During the trial, these quotas are limited to 10% of those of the plan, rounded up to the next whole number. Pandi’s screen displays the counters and gives a warning at 80%. When the quota is reached, the request is refused until the reset, whose date is indicated, or until a change of plan; no overage is invoiced.
Security limits are added to these quotas (number of submissions per minute, computing capacity), which may make a request wait.
Part B — MCP server
B.1 What the server allows
The mcp.ipand.io server implements the MCP protocol (Model Context Protocol). It allows an artificial intelligence assistant of your choice — for example claude.ai or Claude Code (Anthropic), ChatGPT (OpenAI), or any other compatible client — to read the data of your iPand brands in order to answer your questions in its own interface.
Access is read-only: visibility, prompts, market, sources, perception, technical pages, tasks and recommendations. Sole exception: viewing a technical page may close a page analysis that has stalled, as the application screen does. The third-party assistant can neither create, modify nor delete any iPand data.
The MCP server is included in all plans. Each plan sets a number of MCP requests per billing month and per brand (Pricing page; quote for the Custom plan): each tool call that reads a brand counts, except the list of brands. When the quota is reached, the request is refused until the reset or until a change of plan; no overage is invoiced. A security limit of 120 calls per minute and per authorization also applies.
B.2 Authorization
The third-party assistant obtains access through an OAuth authorization that you give on iPand’s consent screen. This screen shows the name of the application, the organization and the brands concerned, flags risky cases (unverified application, return to another site) and links to this appendix. You may refuse.
- The authorization covers one organization; the assistant sees only the brands to which you have access.
- It remains valid as long as it is used at least once every 30 days, or until you revoke it in Settings › Integrations. It ends automatically if you leave the organization or delete your account.
- Consents, refusals and revocations are logged. The tokens of a revoked or expired authorization are erased 30 days later; the record of the authorization (application, organization, dates) is kept until your account or the organization is deleted.
B.3 Transmission of data to the third-party assistant
The data read by the third-party assistant are transmitted to its provider (Anthropic, OpenAI or other) and are then processed by that provider, under its own terms and its own privacy policy, possibly outside the European Union. iPand has no control over this processing: the third-party assistant is not a processor of iPand. The consent screen says so: the application will be able to read your brands’ data, without changing anything, and pass it on to its publisher, under its own terms.
Before authorizing an assistant, make sure that its use complies with your organization’s rules, in particular for your clients’ data.
B.4 Answers of the third-party assistant
The answers produced by the third-party assistant from iPand data are the sole responsibility of that assistant. iPand provides data, not the answers: it is not responsible for their accuracy or their use. Third-party content transmitted (engine answers, page titles) is flagged to the assistant as data, not instructions; this precaution does not guarantee that the third-party assistant will take it into account.
B.5 Fair use
The MCP server may not be used to extract the service’s data on a large scale, to feed a competing service, or to give access to the data to persons who do not have an account in the organization. The Terms of Use apply.
Part C — Other content generated by artificial intelligence
C.1 Content concerned
In addition to Pandi, several features of the application produce content using language models: analysis of collected answers (mention, position, sentiment, sources), page audits, prompts, themes and intents suggested by the Studio, brand profile and questions suggested at onboarding, weekly recommendations and their translations. This content is generated automatically and may contain errors; check it before using or publishing it.
Part D — Changes
D.1 Models and providers
The language models, their provider and the compatible assistants may change. A change of model provider processing personal data is announced in accordance with the procedure of the Data Processing Agreement (Article 6).
